Second teen faces charges of having sex with 12-year-old girl

GRAND LEDGE - A 14-year-old Grand Ledge boy charged as an adult with first-degree criminal sexual conduct videotaped another teenage boy having sex with a 12-year-old girl and distributed the footage to other minors, according to court records.

A 15-year-old Grand Ledge boy charged as an adult with first-degree criminal sexual conduct videotaped another teenage boy having sex with a 12-year-old girl and distributed the footage to other minors, according to court records.

Grand Ledge police obtained a video of the May 7 "sexual encounter" from Brodrick McPhail's cell phone through a search warrant, the records show.

Both McPhail and Hunter Chance, 15, of Ludington were arraigned on charges in connection with the incident earlier this month.

The video shows Chance having sex with the girl in the basement of a Grand Ledge home. Records indicate that the video was then distributed to other minors, although records don't specify how widely it was distributed.

Chance and McPhail face charges of first-degree criminal sexual conduct and child sexually abusive activity. McPhail, who is the son of former Eaton County undersheriff Fred McPhail, faces an additional charge of distributing or promoting child sexually abusive activity.

Fred McPhail retired from the Sheriff's Office two years ago but won the August Republican primary for sheriff. He will face incumbent Democrat Tom Reich in the November general election.

Jamie White, an attorney for Chance, declined to discuss details of the case, but said his office is cooperating "in all ways possible to bring this to a resolution.

"This, in my opinion, is a direct reflection of an unfiltered society where young people have direct access to information that should only be accessible to adults," White said.

Brodrick McPhail's attorney did not respond to messages left seeking comment Wednesday.

Jackson County Prosecutor Jerard Jarzynka, who is serving as prosecutor in the case, did not return phone calls seeking comment this week. Earlier this month he told the State Journal he was appointed to the case to avoid any conflict of interest on the part of Eaton County Prosecutor Doug Lloyd's office.

Brodrick McPhail is free on a $25,000 bond. Chance is being held at the Eaton County Youth Facility.
